ABSTRACT:

The National Union of Entrepreneurs and Artists of Mexicans Circuses (Civil Association) lodged a constitutional claim against the approval, discussion, expedition, sanction, enactment, endorsement and publication of the State Law on Fauna for the State of Morelos, which prohibits the use of animals in circuses. The Judge decided to deny the requested suspension based on weighting the particular interest of the Rights of the Circus Association to develop their preferred economic activity (including the use of animals) against the interest that society has toward avoiding the suffering and mistreatment of animals, concluding that the latter had priority and should prevail over the interests of this Circus Association.
