Law 10/2011, of 29 December, simplifying and improving legislation


This law, published in the Official State Gazette (BOE) of 14/1/2012, regulated many issues including adaptation of Law 19/2009, of 26 November, on accessing the environment by people accompanied by assistance dogs, to the Legislative Decree 2/2008, of 15 April, approving the rewritten text of the law on animal protection. For this purpose, the body or agency appointed by the councillor of the department in charge of social services must be able to suspend the status of assistance dog if any of the following circumstances arise: "There is evidence of any punishable mistreatment of the dog in accordance with the rewritten text of the animal protection law approved by Legislative Decree 2/2008, of 15 April, or the legislation that replaces it.»

Commission implementation decision, of 21 December, amending annex I of Decision 2007/275/EC, concerning the lists of animals and products to be subject to controls at border inspection posts under Council Directives 91/496/EEC and 97/78/EC (OJEU L 21/1, of 24/1/2012)


The animals and products required to undergo the veterinary checks should be clearly identifiable. Accordingly, the list set out in annex I to Decision 2007/275/EC should be brought into line with the terminology and references laid down in the European Regulations that have been laid out over the years. This will be carried out through this Regulation, published in the OJEU of 24/1/2012.

Council Decree 21/2012, of 27 January, regulating the procedure for preparing and approving restoration and conservation plans for catalogued species of wild fauna and flora and the procedure for issuing authorisation related to wild species.


The aim of this decree, published in the Official Gazette of the region of Valencia of 30/1/2012, is to regulate the procedure for preparing and approving restoration and conservation plans for catalogued species of wild fauna and flora in the region of Valencia, including channels that facilitate public participation in this process and simplifying the authorisation processes related to wild species of fauna and flora.

Order AAA/75/2012, of 12 January, which adds different species to the List of Wild Species in the Special Protection Scheme to adapt it to Annex II of the Protocol concerning specially protected areas and biodiversity in the Mediterranean


This order, published in the Official State Gazette (BOE) of 21/1/2012, adds the species that appear in the annex to the List of Wild Species in the Special Protection Scheme, after informing the State Commission for Natural Heritage and Biodiversity, and by virtue of the authorization contained in the second final provision of Royal Decree 139/2011, of 4 February, to develop the List of Wild Species in the Special Protection Scheme and the Spanish Catalogue of Endangered Species.

Commission regulation no. 101/2012, of 6 February 2012, amending Council regulation (EC) no. 338/97, concerning protection of species of wild fauna and flora by controlling trade


It must be taken into account that this regulation, published in the OJEU of 11/2/2012, replaces the extended text in the annex of Council Regulation no. 338/97 concerning protection of species of wild fauna and flora by controlling trade (better known as CITES Regulation).

Regional parliament Decree 7/2012, of 1 February, amending the Regulation for development and implementation of Regional parliament law 17/2005, of 22 December, on Hunting and Fishing in Navarra, approved by Regional parliament decree 48/2007, of 11 June


The regional government of Navarra, through the regional parliament decree published in the Official Gazette of Navarra of 17/2/2012, considered it appropriate to amend two articles related to obtaining a hunting license for residents of other regions where the hunting examination has not yet been introduced; the minimum surface area that local hunting preserves must maintain; the introduction of effective measures to prevent damage; the figure of gamekeeper as a co-participant in other cynegetic population control tasks; the management of special licenses that can be issued from the preserves; issues related to seals to be placed on large game killed and other similar issues. It would be preferable to reconsider this activity and restrict or ban it.

Commission Implementation Decision, of 6 March 2012, concerning funding for emergency interventions related to rabies in northern Greece (OJEU L 69/17, of 8/3/2012)


This commission decision published on 8/3/2012, approved the «Emergency plan for monitoring rabies» presented to the Commission by Greece on 27 January 2012 with a view to granting a financial contribution from the Union for the period running from 27/1/2012 to 31/12/2012. For this purpose, the financial contribution would be no more than €60,000.

Correction of errors in the Commission Executive Decision 2011/874/EU, of 15 December 2011, laying down the list of third countries and territories authorised for imports of dogs, cats and ferrets and for non-commercial movements of more than five dogs, cats and ferrets into the Union and the model certificates for imports and non-commercial movements of those animals into the Union (OJEU L 73/24, of 13/3/2012


The OJEU of 13/3/2012 published an extensive correction of errors in the recently published Decision 2011/874/EU, laying down the list of third countries and territories authorised for imports of dogs, cats and ferrets into the Union and for non-commercial movements of more than five dogs, cats and ferrets into the Union.

Government Council agreement of 13 March 2012 approving restoration and conservation plans for certain wild species and protected habitats


In accordance with the protection of species demands and objectives set out in European, national and regional legislation, this agreement, published in the Official Gazette of the Regional Government of Andalusia of 27/3/2012, approves the Restoration and Conservation plans for certain wild species and protected habitats included in the categories of the Spanish and Andalusian Catalogues of endangered species, and the restoration and conservation plan for dune, sand and cliff species; the Restoration and conservation plan for wetland birds; the Restoration and conservation plan for fern and the Restoration and conservation plan for fish and epicontinental aquatic invertebrates.

Decree 65/2012, of 13 March, regulating the health and zootechnical conditions of animals


This decree, published in the Official Gazette of the Regional Government of Andalusia on 27/3/2012, aims to develop animal health and zootechnical requirements for animals and livestock farms and the conditions that breeding centres must meet and the movement of genetic materials for breeding purposes in the region of Andalusia; create a Unique Livestock Register in Andalusia and finally, create an Epidemiological surveillance system for animals in livestock farms and pets in the region of Andalusia.

Decree 23/2012, of 14 February, regulating conservation and sustainable use of wild flora and fauna and their habitats


This decree, published in the Official Gazette of the Regional Government of Andalusia of 27/3/2012, aims to develop Law 8/2003, of 28 October, on Wild Flora and Fauna in Andalusia, concerning regulating aspects of conservation and sustainable use of wild flora and fauna and their habitats. The regulation in this decree aims to achieve the following objectives: conserve biodiversity, guaranteeing the survival of species through the protection and conservation of wild flora and fauna and their habitats; regulate their uses and guarantee the rights of all to sustainable use and enjoyment of nature. To do this, however, activities such as capturing, intentionally killing or intentionally removing species will need to be eliminated in order to avoid risks to the health and safety of people or wild species, in order to prevent significant damage to agriculture, aquaculture and livestock.
