ABSTRACT

This paper contains Professor de Lucas’ address to the Housing and Environment Commission of the Catalan Parliament in which he examines the question of whether a change in the law to protect animals is (a) justified, (b) necessary and (c) whether the wording of the draft bill is appropriate to fulfill the stated aims. Professor de Lucas quotes the English philosopher, legal and social reformer Jeremy Bentham – (Introduction to the Principles of Moral and Legislation.) From this, he argues, using Bentham’s philosophy, that as bullfighting is essentially mistreatment and torture, it is not only unjustifiable morally but also legally. He also states that any society which permits such a cruel spectacle in the name of “beauty” does not contribute to its members’ moral wellbeing. The address concludes by Professor de Lucas asking the rhetorical question of how much longer bullfighting can be allowed to continue, stating that those who defend it do not do so with society’s best interests at heart. He quotes the philosopher Schopenhauer, saying that if a person is cruel to animals, that person cannot be good.
